REGLEMENT DU JEU PROMOTIONNEL – « Faire gagner la Tech française et européenne »

Article 1 – Présentation de la société organisatrice
La Française des Jeux, société anonyme au capital de 76 400 000 euros, immatriculée au RCS de Nanterre sous le numéro 315 065 292, siégeant au 3-7 quai du Point du Jour – 92650 Boulogne-Billancourt Cedex (ci-après « la Société Organisatrice »), organise un jeu promotionnel dénommé « Faire gagner la Tech française et européenne » (ci-après « l’Opération ») lors du salon France Digitale Day qui aura lieu au Musée des Arts Forains à Paris le mercredi 20 septembre 2023 (dates françaises – France métropolitaine) (ci-après la « Période de Jeu »).
Article 2 – Présentation de l’Opération
Dans le cadre de l’événement France Digitale Day, FDJ et France Digitale vont collaborer pour créer un jeu promotionnel de grattage gratuit intitulé « Faire gagner la Tech française et européenne ».
Chaque visiteur du salon se verra remettre, lors de la présentation de son pass d’accréditation à l’entrée de l’événement, un ticket de grattage. Deux kakémonos, placés près de la zone de distribution des tickets de grattage et un autre sur le stand de la FDJ, informeront les visiteurs des règles du jeu et du type de dotations à gagner.
Le visiteur aura la possibilité de gratter une zone indiquée et découvrir si le ticket est perdant ou gagnant.
Si celui-ci est gagnant, deux catégories de dotations pourront être remportées :

Article 3 – Conditions de participation
3.1. Conditions de participation
Outre les conditions énoncées aux articles 1 et 2 du présent règlement, cette Opération est ouverte à toute personne âgée de 18 ans et plus au jour de sa participation et à l’exclusion de l’ensemble du personnel et de leur famille immédiates de la Société Organisatrice et de ses filiales, et du réseau de distribution (intermédiaires et détaillants) de toute agence impliquée dans la promotion; et toute autre personne liée professionnellement à la promotion, employés, directeurs, responsables et leur famille proche (conjoint, parents, enfants, frère et sœur et leur conjoint respectif), membres de leur foyer.
Toute personne souhaitant participer à l’Opération devra, au jour de sa participation, être titulaire d’une adresse e-mail personnelle, valide au jour de sa participation.
Pour participer à l’Opération, le participant doit nécessairement être présent physiquement sur les lieux de l’Opération.
3.2. Conditions générales
Une seule participation par personne est acceptée. Ainsi, le participant ne pourra prétendre rejouer sur la même Opération. Par conséquent, il est précisé à toutes fins utiles qu’une seule dotation pourra être attribuée par participant.
Les participations en dehors des périodes de l’Opération définies par la Société Organisatrice et/ou incomplètes ne seront pas prises en compte.
La participation à cette Opération implique l’acceptation pleine et entière du présent règlement par le participant et de son application par la Société Organisatrice.
D’une manière générale, toute personne ne respectant pas les conditions énoncées au présent règlement ne pourra prétendre participer à l’Opération pour tenter de gagner l’un des lots mentionnés à l’article 4 du présent règlement et verra sa participation déclarée nulle.
Article 4 – Désignation des gagnants et dotations
4.1. Désignation des gagnants
Seront désignés gagnants, parmi les participants respectant les conditions de participation à l’Opération, les 808 participants ayant obtenu la mention « gagné » sur le ticket de grattage de l’Opération.
4.2. Dotations
4.2.1. Les gagnants désignés selon les modalités définies à l’article 3 du présent règlement remporteront les dotations suivantes :

4.2.2. Le prix des dotations est donné à titre indicatif.
4.2.3. En cas d’indisponibilité ou d’impossibilité de jouir de ce lot pour quelque raison que ce soit, les gagnants perdront leur lot sans qu’aucune indemnité ne leur soit due.
En aucun cas, dans le cadre de l’Opération, le gagnant ne pourra obtenir la valeur en espèces des lots attribués ou demander l’échange de tout ou partie des lots contre un service, un gain en nature de même valeur ou de valeur différente, ni même les céder de quelque manière que ce soit à un tiers.
Cela étant, en cas de force majeure ou d’événements indépendants de sa volonté et si les circonstances l’exigent, la Société Organisatrice se réserve le droit d’attribuer au gagnant un lot de valeur équivalente et de caractéristiques proches.
Article 5 – Information des gagnants
Les gagnants de la dotation décrite à l’article 4 du présent règlement seront informés de leur gain le jour même en grattant le jeu promotionnel tel que détaillé à l’article 4, puis pour certains lots premium par courrier électronique à l’adresse indiquée par le participant dans le formulaire d’inscription mentionné à l’article 3.1 du présent règlement.
Il est précisé qu’il ne sera adressé aucun mail aux participants n’ayant pas remporté de lot.
Article 6 – Modalité d’attribution de la dotation
Le gagnant sera informé directement le jour J pour les goodies à venir récupérer au gift bar.
Pour les dotations premiums :

Si le gagnant n’a pas répondu au courrier électronique et/ou n’a pas fourni les informations/documents demandés dans un délai de trente (30) jours calendaires à compter de son envoi, il perdra tout droit à sa dotation. De ce fait, la dotation restera la propriété de La Française des Jeux qui sera libre de la réattribuer ou non et/ou de la remettre en jeu.
Le gagnant perdra également tout droit à sa dotation dans l’hypothèse où les informations fournies par ses soins dans le cadre de la participation (nom, prénom, date de naissance) ne correspondraient pas aux éléments figurant sur la pièce d’identité envoyée. Dans cette hypothèse la dotation restera la propriété de la Société Organisatrice qui sera libre de la réattribuer ou non et/ou de la remettre en jeu.
Il est rappelé qu’il ne sera mis en jeu que la stricte quantité des dotations énoncées.
D’une manière générale, si l’adresse électronique et/ou postale ne correspond pas à celle du gagnant au moment de l’envoi d’informations relatives à son gain ou si des problèmes de réseau, coupure de courant, de poste devaient empêcher l’acheminement de ces informations, la Société Organisatrice ne pourra en aucun cas en être tenue pour responsable.
Dans ce cas, il n’appartient pas à la Société Organisatrice ou la société chargée de l’envoi des dotations d’effectuer des recherches complémentaires afin de retrouver le gagnant indisponible qui ne recevra pas sa dotation et aucun dédommagement ou indemnité ne lui sera attribué à ce titre.
Enfin, le cas échéant, la Société Organisatrice ne saurait être responsable en cas de retard de livraison, perte et/ou détérioration de la dotation ou d’un élément composant la dotation par voie postale ou tout prestataire de service similaire tiers. De même, la Société Organisatrice décline toute responsabilité pour tout incident ou préjudice de toute nature qui pourrait survenir lors de l’entrée en possession, de la manipulation et/ou de la jouissance de la dotation par le gagnant.
Article 7 – Informations générales
7.1. Les participants pourront obtenir des renseignements en cas de problèmes techniques, en s’adressant au service clientèle de la Société Organisatrice par l’envoi d’un mail en se rendant dans la rubrique « Contactez-nous » disponible sur son site à l’adresse : https://www.fdj.fr/infos/faq ou en cliquant sur le lien « contactez-nous » accessible via la page d’accueil du site www.fdj.fr.
7.2. Tout participant autorise la Société Organisatrice à procéder à toute vérification concernant son identité, ses coordonnées et sa date de naissance.
7.3. Sauf manifestation expresse contraire, les gagnants de l’Opération donne leur autorisation à La Société Organisatrice pendant toute la durée de l’Opération et pendant 6 (six) mois à compter de la fin de l’Opération, sur le territoire de la République Française, Monaco, dans les DROM ou les COM (sauf Wallis et Futuna, Mayotte et la Polynésie française) pour communiquer sur son nom, prénom et/ou image sur quelque support que ce soit (émissions télévisées, actions publi-promotionnelles, reportages, presse, site fdj.fr, pages Facebook et Twitter et compte Instagram FDJ…) sans restriction ni réserve et sans que cela ne lui confère un droit à rémunération ou un avantage quelconque autre que l’attribution des dotations prévues à l’article 4 du présent règlement.
7.4. La Société Organisatrice ne saurait encourir une quelconque responsabilité si, en cas de force majeure ou d’événements indépendants de sa volonté, elle était amenée à annuler, écourter, prolonger, reporter ou modifier les conditions de participation (modification des modes d’accès à l’Opération dès le début de l’Opération ou en cours d’Opération…) et les modalités de fonctionnement de la présente Opération.
Enfin, la Société Organisatrice ne peut être tenue pour responsable de perturbations ou de pertes de courrier pouvant survenir dans les services postaux ou électroniques.
7.5. Toute participation à l’Opération implique l’adhésion au présent règlement. Toute fraude, ou tentative de fraude, manifestée par un commencement d’exécution et commise en vue de percevoir indûment un lot, ou le non-respect du présent règlement, ou toute intention malveillante de perturber le déroulement de l’Opération, pourra donner lieu à l’éviction de son auteur, la Société Organisatrice se réservant, le droit d’engager à son encontre des poursuites judiciaires.
7.6. La Société Organisatrice se réserve la possibilité d’apporter toute modification au règlement de l’Opération, à tout moment, sans préavis, ni obligation de motiver sa décision et sans que sa responsabilité ne puisse être engagée de ce fait. Dans l’hypothèse de modifications, celles-ci feraient alors l’objet d’un avenant au règlement de l’Opération déposé chez un commissaire de justice et d’une information sur le lieu de l’Opération. Le participant est réputé avoir accepté ces modifications du simple fait de sa participation à l’Opération à compter de la date d’entrée en vigueur de la modification.
7.7. Toute contestation ou réclamation relative à l’Opération doit être formulée par écrit et envoyée à : La Française des Jeux, Service Clients FDJ, Opération « « Faire gagner la Tech française et européenne», TSA 36 707- 95 905 CERGY PONTOISE CEDEX 9 ou via le formulaire de contact disponible dans la rubrique « Besoin d’aide/Contactez-nous » du site www.fdj.fr (https://www.fdj.fr/infos/faq).
Toute difficulté d’interprétation ou d’application du présent règlement sera tranchée souverainement par La Société Organisatrice.

7.8. Le règlement complet de l’Opération est déposé auprès de la SELARL ATLAS JUSTICE – Commissaires de Justice, 14 terrasse Bellini – 92800 PUTEAUX-PARIS LA DEFENSE.
Le règlement de l’Opération est adressé, à titre gratuit, à toute personne qui en fait la demande dans un délai de 90 jours à compter de la fin de l’Opération en écrivant à : La Française des Jeux, «Faire gagner la Tech française et européenne », 3-7 Quai du Point du Jour – 92100 Boulogne Billancourt ou via le formulaire de contact disponible dans la rubrique « Besoin d’aide/Contactez-nous » du site www.fdj.fr (https://www.fdj.fr/infos/faq).
7.9. Données personnelles
Les données à caractère personnel des participants, collectées dans le cadre de l’Opération sont utilisées exclusivement par et/ou pour la Société Organisatrice à des fins de gestion de l’Opération, notamment en vue du contrôle des conditions d’éligibilité, de la détermination du gagnant ainsi que pour la remise de la dotation. Elles sont conservées par la Société Organisatrice pendant toute la durée de l’Opération et pendant le temps strictement nécessaire au traitement des éventuelles réclamations, jusqu’à 5 ans après la fin de l’Opération.

Ces informations pourront également être utilisées par la Société Organisatrice à des fins de sollicitation commerciale si vous en avez émis le souhait en cochant la case correspondante sur l’un des sites ou formulaires de la Société Organisatrice.
Par ailleurs, les communications téléphoniques avec le Service Clients sont susceptibles d’être enregistrées à des fins d’amélioration de la qualité de service.
Conformément à la loi informatique et liberté n°78-17 modifiée et au Règlement 2016/679 du Parlement européen et du Conseil du 27 avril 2016, les participants disposent d’un droit à la limitation du traitement de leurs données, d’un droit d’opposition, d’accès, de portabilité, de rectification et de suppression des données à caractère personnel les concernant, qu’ils peuvent exercer sur simple demande écrite envoyée à : La Française des Jeux, Service Client FDJ, «« Faire gagner la Tech française et européenne» , TSA 36 707 – 95 905 CERGY PONTOISE CEDEX ou via le formulaire de contact disponible dans la rubrique « Besoin d’aide/Contactez-nous » du site www.fdj.fr.
Si la dotation remportée le cas échéant par le Participant peut également bénéficier à une personne de son choix, La Société Organisatrice est susceptible de recueillir les données à caractère personnel de cette personne dans les conditions décrites au présent article. Le Participant s’engage à fournir à la personne qu’il a choisie l’ensemble des informations prévues aux présentes.
7.10. Propriété industrielle et intellectuelle
La reproduction, la représentation ou l’exploitation de tout ou partie des éléments composant l’Opération sont strictement interdites.
7.11. Le présent règlement est soumis à la loi française.

Article 1 – Presentation of the organizing company
La Française des Jeux, a public limited company with capital of 76,400,000 euros, registered with the Nanterre Trade and Companies Register under number 315 065 292, with its registered office at 3-7 quai du Point du Jour – 92650 Boulogne-Billancourt Cedex (hereinafter referred to as « the Organizing Company »), is organizing a promotional game entitled « Make French and European Tech Win » (hereinafter referred to as the « Operation ») during the France Digitale Day trade show, which will take place at the Musée des Arts Forains in Paris on Wednesday, September 20, 2023 (French dates – mainland France) (hereinafter referred to as the « Game Period »).
Article 2 – Presentation of the Operation
As part of the France Digitale Day event, FDJ and France Digitale will be working together to create a free promotional scratch card game entitled « Make French and European Tech Win ».
Each visitor to the show will receive a scratch-off ticket when they present their accreditation pass at the event entrance. Two kakemonos, placed near the scratch ticket distribution area and another on the FDJ stand, will inform visitors of the rules of the game and the type of prizes to be won.
Visitors will be able to scratch off an indicated area and find out whether the ticket is a winner or a loser.
If the participant wins, two categories of prizes may be won:
Either the participant discovers a symbol indicating the category of prizes won (FDJ or France digitale branded goodies). Prizes corresponding to a symbol can be collected from the gift bar, located in the central aisle of the show.
Or the participant can see directly on his/her winning ticket the inscription of the prize won in the category of premium prizes made available by FDJ and France Digitale. FDJ premium prizes can be collected directly from the FDJ stand, while France Digitale premium prizes can be collected from the gift bar in the show’s central aisle.

Article 3 – Conditions of participation
3.1 Conditions of participation
In addition to the conditions set out in articles 1 and 2 of these rules, this Operation is open to all persons aged 18 and over on the day of their participation and excluding all staff and their immediate families of the Organizing Body and its subsidiaries, and the distribution network (intermediaries and retailers) of any agency involved in the promotion; and any other person professionally linked to the promotion, employees, directors, managers and their immediate families (spouse, parents, children, brother and sister and their respective spouses), members of their household.
Any person wishing to participate in the Operation must have a personal e-mail address valid on the day of participation.
To take part in the Operation, the participant must be physically present at the Operation site.
3.2 General terms and conditions
Only one entry per person is accepted. The participant may not claim to participate again in the same Operation. Consequently, it is specified for all intents and purposes that only one prize may be awarded per participant.
Entries made outside the Operation periods defined by the Organizing Body and/or which are incomplete will not be taken into account.
Participation in this Operation implies full acceptance of the present rules by the participant and their application by the Organizing Body.
Generally speaking, any person who does not comply with the conditions set out in the present rules may not participate in the Operation to try to win one of the prizes mentioned in article 4 of the present rules, and his/her participation will be declared null and void.
Article 4 – Designation of winners and prizes
4.1. Designation of winners
The 808 participants who have obtained the word « won » on the Operation scratch card will be designated winners, from among the participants who have complied with the conditions for participation in the Operation.
4.2. Prizes
4.2.1. The winners designated in accordance with the terms and conditions set out in article 3 of these rules will receive the following prizes:
If a symbol is present on the ticket: the player wins an FDJ branded goodie (x340) or a France Digitale branded goodie (x446)) and can collect it directly from the gift bar, located in the central aisle. A prize board will also be available to view the prizes corresponding to the symbol displayed on the ticket.
For premium prizes: the prize will be notified directly on the ticket and the participant will have to come to the FDJ stand (location F3) so that we can retrieve this personal information to send the premium prize.

4.2.2. The price of the prizes is given as an indication.
4.2.3. In the event of unavailability or impossibility of enjoying the prize for any reason whatsoever, the winners will lose their prize without any compensation being due to them.
Under no circumstances, in the context of the Operation, may the winner obtain the cash value of the prizes awarded or request the exchange of all or part of the prizes for a service, a gain in kind of the same or different value, or even transfer them in any way whatsoever to a third party.
However, in the event of force majeure or events beyond its control, and if circumstances so require, the Organizing Body reserves the right to award the winner a prize of equivalent value and similar characteristics.
Article 5 – Winner information
Winners of the prizes described in article 4 of the present rules will be informed of their win on the same day by scratching the promotional game as detailed in article 4, then for certain premium prizes by e-mail to the address indicated by the participant in the registration form mentioned in article 3.1 of the present rules.
It is specified that no e-mail will be sent to participants who have not won a prize.
Article 6 – How the prize is awarded
The winner will be informed directly on D-day for goodies to be collected at the gift bar.
For premium prizes :

If the winner does not reply to the e-mail and/or does not provide the information/documents requested within thirty (30) calendar days of the e-mail being sent, he/she will lose all rights to his/her prize. As a result, the prize will remain the property of La Française des Jeux, which will be free to reallocate it or not and/or to put it back into play.
The winner will also lose all rights to his or her prize in the event that the information provided by him or her as part of the entry (surname, first name, date of birth) does not correspond to the information on the identity document sent. In this case, the prize will remain the property of the Organizing Body, which will be free to reallocate it or not and/or to put it back into play.
It is reminded that only the strict quantity of the stated prizes will be put into play.
Generally speaking, if the e-mail and/or postal address does not correspond to that of the winner at the time of dispatch of information relating to his/her prize, or if network, power cut or postal problems prevent the dispatch of this information, the Organizing Body may in no case be held responsible.
In this case, it is not the responsibility of the Organizing Company or the company responsible for sending the prizes to carry out additional research in order to find the unavailable winner, who will not receive his or her prize, and no compensation or indemnity will be awarded in this respect.
Finally, where applicable, the Organizing Body may not be held liable in the event of late delivery, loss and/or deterioration of the prize or a component of the prize by the postal service or any similar third-party service provider. Likewise, the Organizing Body declines all responsibility for any incident or prejudice of any kind that may arise during the winner’s possession, handling and/or enjoyment of the prize.
Article 7 – General information
7.1. Participants may obtain information in the event of technical problems by contacting the Organizing Body’s customer service department by sending an e-mail to the « Contact Us » section of its website at https://www.fdj.fr/infos/faq or by clicking on the « contact us » link accessible via the home page of the www.fdj.fr website.
7.2. All participants authorize the Organizing Body to verify their identity, contact details and date of birth.
7.3. Unless otherwise expressly stated, the winners of the Operation give their permission to the Organizing Body for the duration of the Operation and for 6 (six) months from the end of the Operation, on the territory of the French Republic, Monaco, in the DROM or COM (except Wallis and Futuna, Mayotte and French Polynesia) to communicate on his name, first name and / or image in any medium whatsoever (television broadcasts, advertising-promotional actions, reports, press, fdj website. fr website, Facebook and Twitter pages and FDJ Instagram account…) without restriction or reservation and without this conferring any right to remuneration or benefit whatsoever other than the awarding of the prizes provided for in article 4 of these rules.
7.4. The Organizing Body may not be held liable in any way whatsoever if, in the event of force majeure or events beyond its control, it is obliged to cancel, shorten, extend, postpone or modify the conditions of participation (modification of the means of access to the Operation from the start of the Operation or during the Operation, etc.) and the terms and conditions of operation of this Operation.
Finally, the Organizing Body cannot be held responsible for any disruption or loss of mail that may occur in postal or electronic services.
7.5. Participation in the Operation implies acceptance of the present rules. Any fraud, or attempt at fraud, manifested by a beginning of execution and committed with a view to improperly collecting a prize, or failure to comply with the present rules, or any malicious intent to disrupt the operation, may result in the disqualification of its author, with the Organizing Body reserving the right to take legal action against the latter.
7.6. The Organizing Body reserves the right to modify the rules of the Operation at any time, without prior notice or obligation to justify its decision, and without being held liable in any way. In the event of modifications, these will be the subject of an amendment to the rules of the Operation filed with a court commissioner and of information on the location of the Operation. The participant is deemed to have accepted these modifications simply by participating in the Operation from the date on which the modification comes into force.
7.7. Any dispute or claim relating to the Operation must be made in writing and sent to : La Française des Jeux, Service Clients FDJ, Opération « »Faire gagner la Tech française et européenne », TSA 36 707- 95 905 CERGY PONTOISE CEDEX 9 or via the contact form available in the « Need help/Contact us » section of the www.fdj.fr website (https://www.fdj.fr/infos/faq).
Any difficulty in interpreting or applying these rules will be settled by the Organizing Company.

7.8. The complete rules of the Operation are deposited with SELARL ATLAS JUSTICE – Commissaires de Justice, 14 terrasse Bellini – 92800 PUTEAUX-PARIS LA DEFENSE.The rules of the Operation are sent, free of charge, to any person who requests them within 90 days of the end of the Operation by writing to : La Française des Jeux, « Faire gagner la Tech française et européenne », 3-7 Quai du Point du Jour – 92100 Boulogne Billancourt or via the contact form available in the « Need help/Contact us » section of the www.fdj.fr website (https://www.fdj.fr/infos/faq).
7.9. Personal data
Participants’ personal data collected as part of the Operation is used exclusively by and/or for the Organizing Body for the purposes of managing the Operation, in particular for checking eligibility conditions, determining the winner and awarding the prize. It will be kept by the Organizing Body for the duration of the Operation and for the time strictly necessary to process any complaints, up to 5 years after the end of the Operation. This information may be transmitted :
to third parties linked to the Organizing Body for internal processing purposes,
to partners if you have expressed your wish by ticking the corresponding box on one of the Organizing Body’s sites or forms,
and to any competent authorities or organizations.
This information may also be used by the Organizing Company for commercial solicitation purposes if you have expressed your wish by checking the corresponding box on one of the Organizing Company’s sites or forms.
In addition, telephone communications with Customer Service may be recorded for the purpose of improving the quality of service.
In accordance with the French Data Protection Act no. 78-17 as amended and Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, participants have the right to limit the processing of their data, and the right to oppose, access, portability, rectify and delete their personal data, which they may exercise by sending a written request to: La Française des Jeux, Service Client FDJ, « Faire gagner la Tech française et européenne », TSA 36 707 – 95 905 CERGY PONTOISE CEDEX or via the contact form available in the « Need help/Contact us » section of the www.fdj.fr website.
If the prize won by the Participant may also benefit a person of his/her choice, the Organizing Body may collect the personal data of this person under the conditions described in this article. The Participant undertakes to provide the person he/she has chosen with all the information specified herein.
7.10. Industrial and intellectual property
The reproduction, representation or exploitation of all or part of the elements making up the Operation is strictly forbidden.
7.11. These rules are governed by French law.
